US Man To Stand Trial Over Murder of Kerry Farmer Michael Gaine

A 54-year-old US national accused of murdering Kerry farmer Michael Gaine is to stand trial before the next sittings of the Central Criminal Court.

Michael Kelley, who has no fixed address but previously lived in Tralee, appeared before Tralee District Court after being served with the book of evidence in the case. He is charged with the murder of 56-year-old Michael Gaine on a date between 20 and 21 March 2025.

Mr Kelley has remained in custody since his first court appearance on 25 February, when the court heard he made no reply after being formally charged. In recent months, he had appeared before the court by video link from Cork Prison while awaiting the completion of the book of evidence.


At today’s hearing, defence solicitor Patrick Mann confirmed that the book had now been served on his client. The court was told that the Director of Public Prosecutions had directed that Mr Kelley be sent forward for trial to the Central Criminal Court.

Judge David Waters asked the accused if he understood the meaning of an alibi. Mr Kelley replied, “Yes Sir” and “Yes, your Honour” when the question was repeated. The judge informed him that any alibi defence must be provided within 14 days.

An application for free legal aid, including representation by a solicitor and two barristers, was granted. Judge Waters also noted that bail could not be considered at District Court level.

As he left the courtroom, Mr Kelley thanked his solicitor. He appeared with short hair, a neatly trimmed beard, a green polo shirt and light-coloured trousers.

Mr Gaine’s widow, Janice, attended the hearing alongside several relatives and friends of the late farmer.

Mr Gaine was reported missing on 21 March, sparking a major search operation. Gardaí upgraded the investigation to a homicide inquiry on 29 April, and later confirmed that human remains discovered on his lands at Carrig East were those of the missing farmer.
