Mariah Carey No Longer Facing Lawsuit Over Festive Classic

The lawsuit which was launched back in June, was dropped by “in its entirety, without prejudice” by Andy Stone. This means that Mr Stone can file this lawsuit again.

According to the original suit, Mr Stone claimed that he had released the track before Carey did. He alleged that he released the track under the name Vince Vance and the Valiants in 1989. Carey released the track in 1994.

Mariah Carey and her co writer Walter Afanasief were accused by Stone of creating a "derivative" version of the track without Stone's permission. 

The suit also claimed that as Stone's song had predated Carey's, he should have been granted copyright on subsequent works, regarding the title. He also alleged that their original track's "extensive airplay" during the 1993 Christmas season would have meant that Carey and her co writer were aware of Stone's track. 

Stone was initially seeking $20 million over alleged copyright infringement. 

Case Dropped 

Following this, the case was dropped on Novemer 1, the day after Halloween. Fittingly, November 1 is also the date that Carey and the corners of the internet call the official start of the 'A I Want For Christmas' season. 

Other reports have also suggested that Stone's case was filed under some shaky ground. It was revealed that there are 177 copyrighted songs with the title 'All I Want For Christmas Is You', with many of these tracks written before Vince and the Valiants' version.
